  • 1.  Website Privacy Policies, Cookies, Etc

    Wondering how other Model A sponsors handle the fact that all project’s websites are legally your website within the context of ensuring privacy policies, cookie opt-in/out, terms of use, ADA Compliance, etc are posted and “right”. Seems like not having a standard for all websites exposes us to risk but we have historically not paid a ton of attention to project websites. Thanks!

    When I was at TSNE I created one umbrella privacy policy and terms of use with appropriate safe harbor language and we had (or at least tried to get) all our projects link to those on the bottom of their websites. That way, when we made updates, all of theirs would be updated. I recall we used what the Creative Commons website had as a starting point. Then, if a project was doing something that required something different, we’d work with them to create a addendum to the umbrella terms.

    @Josh Sattely Does Social Impact Commons have any sort of templates for this? I’m guessing by your reply that you do not but I figured I’d ask!

    @Lisa Dugdale We don’t and you wouldn’t simply want to cut and paste. As mentioned, I like what creative commons does (see links at footer of their website https://creativecommons.org/) as they’re written mostly in plain language but it’ll take some attention and planning to tailor them for your org and get folks to implement

    Our Compliance team recently flagged this as an especially important issue given increased regulator attention during an election year, so we’ve put a lot of effort into getting projects to update their sites. It has taken multiple one-on-one outreach efforts per project—including fairly strong language that we don’t usually use around it being required and why it matters to other partners if one is out of compliance. Like Josh, we are providing templates for privacy policy, data use, and disclosure, and having folks link to a page we control with state disclosure language. Finally, we’re packaging this in a “website toolkit” that includes other things partners have asked for, like guidance on logo usage, cyber security, ADA compliance, etc, so hoping that will encourage uptake, too, and adding it to our onboarding process to try to get new partners started on the right foot.
